Terms of service

By accessing or using Lovino.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

Lovino.ai is an AI-powered image and video creation service, on the website and in the Lovino app. It includes, among other features:

• Image and video generation from text prompts and from your own photos, using a range of third-party AI models
• Editing tools such as background removal, upscaling, object removal, style transfer and face swap
• Templates, Motion Control (putting a person into a movement or dance video), Lens ID and AI influencer tools, travel and portrait tools (Teleport, Duo Travel, GlowUp, TimeTravel, Portrait HD)
• Iris, an assistant that plans and runs creations for you
• Business tools such as Ad Studio, product photos and Fashion Studio, and Flow for content packs
• A private Library for your uploads and creations, and Explore, where you may choose to share a creation (off by default)

Features change over time. These Terms apply to every feature, including new ones.

You must be at least 16 years old to create an account or use the Service, on the website or in the Lovino app. If you are under 16, you may not use the Service.

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for:

• Safeguarding your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

Our Content policy explains these rules in plain words. You agree not to use the Service to create, upload, share or attempt to create:

• Sexual, nude or sexually explicit content of anyone
• Intimate or sexual imagery of a real person without their consent, including "undressing", face-swapped or otherwise manipulated images
• Any sexual or sexualised content involving minors, real or fictional, or any content that endangers children
• Content that impersonates, harasses, threatens, bullies or humiliates a real person, or that is defamatory
• Deepfakes or other content intended to deceive people about what a real person said or did, including content meant to mislead voters or the public
• Content that promotes violence, terrorism, hatred or self-harm, or that is otherwise illegal where you live or where it is shared
• Content that infringes anyone's copyright, trademark or other rights

You also agree not to:

• Try to get around our safety checks or filters, for example by rewording blocked prompts or splitting a request into parts
• Remove, hide or alter watermarks, AI labels or other markings that show content was made with AI
• Create more than one account to avoid a suspension or ban, or share or sell access to your account
• Use bots, scrapers or other automated access, except through an API we provide for that purpose
• Attempt to reverse engineer or extract our AI models, or overload or disrupt the Service

Face and Likeness Rules When a feature uses a photo of a person (for example face swap, Motion Control, Lens ID, travel and portrait tools):

• Only upload photos of yourself, or of people who have clearly agreed to it
• Photos of children (anyone under 16) are only allowed together with a parent or guardian, for example a family photo, and only when that parent or guardian uploads it. For safety, we may block photos that show only children
• You may not use another person's likeness without their permission, or for impersonation, identity fraud or harassment
• For Duo Travel, both people must agree to the use of their photos

"Your content" means the prompts, photos, videos, audio and other material you upload or enter, and what you create with them.

When you use the Service, you promise that:

• You own your content or have every right and permission needed to use it with the Service, including the consent of every person shown
• Your content and the way you use the results do not break these Terms, our Content policy or any law

You keep your rights in your content. You give us a non-exclusive, worldwide, royalty-free licence to host, process, store and display your content only as needed to run the Service for you (for example, to send it to our AI providers and show your results), and, if you choose to share to Explore, to show it there until you stop sharing. We do not use your content to train AI models without your consent.

You are responsible for your content and for how you use what you create, including whether you share or publish it.

Certain features use a photo of a face. By uploading one, you agree that:

• The photo is sent to third-party AI providers (including Replicate, Google and OpenAI) to make your result and to run safety checks, such as checking that the person does not appear to be a minor
• Face photos are used only to make your result and for those safety checks, never for facial recognition, identification or surveillance
• Photos you upload as a one-off input to a tool are deleted automatically within 24 hours. Photos you save on purpose, such as a Lens ID, are kept until you delete them or your account
• Results that show your likeness are kept according to your account type and settings
• You can ask us to delete your face photos at any time by contacting [email protected] or by deleting them in the app

We do not sell, license or share face photos for any purpose other than making the content you asked for and keeping the Service safe. See our Privacy Policy for details.

To keep the Service safe and lawful, we may:

• Screen prompts, uploads and results automatically, and review content when there is a report or a safety concern
• Block a request, remove content, or limit, suspend or close an account, with or without notice, if we believe it breaks these Terms or the law. Automated screening is not perfect, so we may also act on content it missed
• Report illegal content, in particular child sexual abuse material, to the relevant authorities and organisations, and keep the related data where the law requires or allows it

If a request is blocked before or during generation, any credits taken for it are refunded. If we suspend or close your account because you broke these Terms or our Content policy, to the extent permitted by law you lose access to any remaining credits and subscription time, and they are not refunded.

When we remove your content or restrict your account, we aim to tell you why, where we can and unless the law or safety prevents it.

Anyone can report content on the Service that they believe is illegal or breaks our rules, including an image that shows them without their consent. Email [email protected] with the link or a description and why you believe it breaks the law or our rules. See also our Copyright policy.

If we removed your content or restricted your account and you disagree, you can ask us to look again by emailing [email protected] within 6 months. We review appeals and correct our mistakes. If you live in the EU, you may also use a certified out-of-court dispute settlement body or the courts.

Everything you make with Lovino is created by AI. If you share or publish content that shows a real person, or that could be mistaken for a real photo or video, you must make clear that it is AI-generated where the law requires it, and you must never present it as authentic to deceive anyone.

The Service and its original content (excluding User Content) remain the property of Lovino.ai and are protected by copyright, trademark, and other laws.

For content you generate:

• You retain rights to use generated images and videos for personal and commercial purposes
• Free tier users: generated images include a Lovino watermark
• Paid users: receive watermark-free content with full usage rights
• You may not claim AI-generated images as photographs or human-created art without disclosure

Explore is private by default. Nothing you create appears on Explore unless you tap Share to Explore on that item. You can turn sharing off again at any time. Creations made from a photo can't be shared. We may remove shared content that breaks these Terms.

Free accounts receive a limited number of daily generations (with watermark). Additional credits can be purchased through our pricing plans.

• Purchased credit packs never expire
• Unused subscription credits roll over for up to 3 months
• Credits are non-refundable unless otherwise required by law
• If you cancel a paid subscription, your credits remain available until the end of the billing period you have already paid for, and are removed when that period ends
• If you resubscribe within 30 days, the balance removed at cancellation is restored to your account
• Prices are subject to change with reasonable notice
• All payments are processed securely through Stripe

Plans and changes. We may add, change or retire plans, prices, the number of credits in a plan, how many credits a tool or model costs, and which features a plan includes. If a change affects a paid subscription you already have, we will tell you in advance (by email or in the app) and it will apply from your next billing period; you can cancel before then. Plans we no longer sell keep working for current subscribers until they cancel or until we move them to a current plan, with notice. Purchases made through the App Store or Google Play also follow those stores' rules on price changes.

To the extent permitted by law, you agree to compensate Foldox Limited and its directors, employees and partners for any claims, losses and reasonable costs (including legal fees) that arise from your content, your use of the Service in breach of these Terms or the law, or your infringement of anyone's rights. This does not limit any rights you have as a consumer that cannot be limited by contract.

In no event shall Lovino.ai, its directors, employees, partners, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use or inability to use the Service
• Any unauthorized access to your account
• Any content generated through the Service
• Any errors or omissions in the Service

Our liability is limited to the amount you paid for the Service in the past 12 months.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding:

• The accuracy or reliability of generated images or videos
• The Service meeting your specific requirements
• Uninterrupted or error-free operation
• The correction of defects

AI-generated content may not accurately represent real locations, may contain visual artifacts, and should not be relied upon as factual representations.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to new terms taking effect.

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.

Lovino.ai is operated by Foldox Limited, a company registered in Ireland.

These Terms shall be governed by and construed in accordance with the laws of the European Union and the laws of Ireland, the member state in which Foldox Limited is established, without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through the competent courts of Ireland.

The Service is provided by Foldox Limited, a company registered in Ireland.
